UPVC CO ZA (PTY) LTD TERMS & CONDITIONS
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SELLER’S SERVICE.
THE BUYER ACKNOWLEDGES THAT THEY HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS SET OUT BELOW.
THE SELLER SHALL DEEM THAT THE BUYER ACCEPTS THE TERMS AND CONDITIONS SET OUT BELOW AND ACCEPTS THEM AS BINDING WHEN PLACING AN ORDER FOR MADE-TO-ORDER (MTO) PRODUCTS OR PAYING THE DEPOSIT.
1. INTRODUCTION
1.1 The Buyer can access the Seller’s Website at www.upvc.co.za (the “Website”), which is owned and operated by the Seller (UPVC CO ZA (Pty) Ltd).
1.2 These Terms and Conditions govern the ordering, sale and delivery of Made-To-Order Goods.
1.3 These Terms and Conditions are binding and enforceable against every Buyer.
1.4 The Website enables the Buyer to shop for Made-To-Order uPVC products including windows and doors.
1.5 The Consumer Protection Act may apply.
2. IMPORTANT NOTICE
2.1 These Terms apply to CPA, ECTA and POPIA.
2.2 These Terms contain provisions that may limit risk or liability of the Seller.
2.3 The Buyer’s attention is drawn to these clauses.
2.4 The Buyer must understand these Terms before placing an order.
3. DEFINITIONS
3.1 Seller means UPVC CO ZA (Pty) Ltd (Reg No: 2025/511760/07)
3.2 Buyer means the person placing the order
3.3 MTO means Made-To-Order
3.4 Goods means Products supplied
3.5 Special Order Goods means custom-made products including glass
3.6 Third Party means independent service provider
3.7 Product means MTO Goods
3.8 Website means www.upvc.co.za
5. CONDITIONS OF SALE
5.1 Orders subject to acceptance and payment
5.2 Acceptance occurs after payment and production confirmation
5.3 Cancellation must be in writing
PRODUCTION PHASE 1:
Drawings finalised, materials ordered or prepared
Buyer liable for 70%
PRODUCTION PHASE 2:
Products completed or ready
Buyer liable for 100%
5.6 Drawings and images are for guidance only
5.7 No reliance placed on external representations
6. MADE-TO-ORDER GOODS
6.1 Manufactured to industry standards
6.2 Minor variations not defects
6.3 Buyer must ensure suitability
6.4 Manufactured to supplied sizes
6.5 Seller not responsible for measurement errors
7. INSTALLATION & PERFORMANCE
7.1 Performance depends on installation, glazing and site conditions
7.2 Unless included, responsibility rests with Buyer
7.3 Seller not liable for performance issues outside its control
8. GLAZING
8.1 Supply Only: Sizes indicative only, installer must confirm
8.2 Supply + Installation: Seller responsible within scope only
9. PRICE
9.1 Price fixed once deposit received
9.2 Variations charged additionally
10. PAYMENT
10.1 Deposit required
10.2 Orders under R10,000 full payment
10.3 Payment via EFT or PayGate
11. DELIVERY
11.1 Delivery drop-off only
11.2 Buyer responsible for offloading
11.3 Driver waits 20 minutes
11.4 Redelivery charged
11.5 Risk transfers on delivery
11.6 Damage reported within 24 hours
12. NON-ACCEPTANCE AND STORAGE
12.1 Storage charges apply
12.2 Goods at Buyer’s risk
12.3 After 6 weeks Seller may cancel contract
13. RETURNS
13.1 No returns on MTO or glass
13.2 Only valid for delivery damage
14. DEFECTS
Limited to manufacturing, material, or hardware faults
15. WARRANTY
Frames: 10 years
Hardware: 1 year
Glass: manufacturer warranty
16. FORCE MAJEURE
No liability for delays outside control
17. LIMITATION OF LIABILITY
Seller not liable for indirect loss
Buyer indemnifies Seller
